Terms and Conditions for Merl's Simulcast Salvage Auto Auction:
Please read the following terms and conditions carefully before participating in Merl's simulcast salvage
auto auction. By registering and participating in the auction, you acknowledge and agree to these terms
and conditions.
1. Eligibility: Participants must be 18 years of age or older and possess a valid driver's license or
Government issued identification card to participate in the auction. The auction is open to both individuals
and businesses.
2. Registration: All participants must register for the auction by providing accurate and complete
information, including their name, contact information, and valid identification. Participants are responsible
for maintaining the confidentiality of their login credentials and are liable for any activity conducted using
their account.
3. Auction Process: Merl's simulcast salvage auto auction allows participants to place bids on salvage
vehicles via live video streaming and online bidding platforms. Participants will have the opportunity to
place bids during the auction and compete with other participants.
4. Vehicle Description: All vehicles listed for auction will have a detailed description including its make,
model, year, mileage, VIN number, condition report, and any damages or issues. It is the participant's
responsibility to review the vehicle description and condition report before placing a bid.
5. Bidding: Participants may place bids on vehicles during the auction.
6. Bid Increments: The auctioneer will announce the bid increments during the auction.
Participants must follow the announced bid increments when placing their bids.
7. Winning Bid: The highest bid at the close of the auction will be considered the winning bid.
The auctioneer has the sole discretion to accept or reject any bid. In the event of a dispute, the
auctioneer's decision will be final.
8. Binding Contract: By placing a bid, participants are entering into a binding contract to
purchase the vehicle at the winning bid amount, plus any applicable fees or taxes. Participants
are responsible for reviewing and understanding any additional fees or taxes before placing a
bid.
9. Payment: The winning bidder must make payment within the specified timeframe, typically
within 24 hours of the auction's close. Payment must be made in full. Failure to complete
payment may result in the cancellation of the sale and the bidder may be banned from future
auctions.
10. Vehicle Pickup: Once payment has been received and cleared, the winning bidder will be
provided with instructions for vehicle pickup. It is the responsibility of the winning bidder to
arrange for transportation, towing, or any necessary permits to retrieve the vehicle. The auction
company will not be responsible for any costs or damages incurred during the pickup process.

11. Vehicle Title: The auction company will provide a Bill of Sale and/or a Salvage Title for the
purchased vehicle. It is the responsibility of the winning bidder to complete any necessary
paperwork and pay any applicable fees for transferring the title.
12. Vehicle Condition: All vehicles are sold "as is" and "where is". The auction company
does not guarantee the condition or functionality of any vehicle. Participants are advised to
perform due diligence, including inspecting the vehicle or obtaining an independent vehicle
inspection, before placing a bid.
13. Liability: Participants acknowledge that the auction company is not responsible for any
accidents, injuries, damages, or loss that may occur during or as a result of the auction or the
use of any purchased vehicle.
14. Auction Modifications: The auction company reserves the right to modify or cancel the
auction at any time, without prior notice.
15. Indemnification: Participants agree to indemnify and hold harmless the auction company, its
employees, agents, and representatives from any claims, liabilities, costs, or damages arising
out of or related to their participation in the auction.
16. Governing Law: These terms and conditions shall be governed by and construed in
accordance with the laws of the jurisdiction in which the auction is conducted.
17. Entire Agreement: These terms and conditions constitute the entire agreement between the
participant and the auction company regarding the simulcast salvage auto auction.
By participating in the simulcast salvage auto auction, participants acknowledge that they have
read, understood, and agree to abide by these terms and conditions.
